A Range Rover will be confiscated from the mother of a Kyiv deputy; the deputy will go to the ECHR

The Kiev city prosecutor’s office reported that it proved in court that the Kiev City Council deputy committed an offense related to corruption – now his mother’s Range Rover car will be confiscated. Deputy Igor Opadchiy said that this decision will be appealed to the European Court of Human Rights.

Literally the prosecutor’s office: “It has been established that the mother of a Kyiv City Council deputy, with the help of his assistant-consultant, purchased a 2020 Range Rover Sport from a legal entity in 2022 for 65 thousand hryvnia.
At the same time, in his declaration for 2023, the deputy noted the use of the car, indicating its cost at more than 2.3 million hryvnia. Having examined the case materials, the court recognized the purchase of the car at a significantly reduced price as a gift to a close friend of the deputy, which is prohibited by the law “On the Prevention of Corruption.”
Details: The prosecutor’s office traditionally does not name the violator, but, according to UP sources, we are talking about Deputy from the party “UDAR Vitaliy Klitschko” Igor Opadch.
The Shevchenko District Court found the deputy guilty of committing an administrative violation under Part 1 of Art. 172-5 of the Code of Administrative Offenses and imposed a fine on him in the amount of 2,550 hryvnia with confiscation of the gift – Range Rover Sport.
The prosecutor’s office added that the Kyiv Court of Appeal upheld the decision of the trial court.
Added: Igor Opadchiy, in a comment to Ukrayinska Pravda, said that this decision will be appealed to the European Court of Human Rights.
According to him, his mother was the renter of the mentioned car. The deputy’s wife also used it. In February 2022, my wife got into an accident in this car. After this, the company that owns the car offered the tenant to buy “the remains of the car” for 65 thousand hryvnia. And accordingly, in 2022, his mother bought these “remnants of the car after an accident, in fact it is the body and the engine.” During the same year 2022, this car was repaired.
Opadchiy added that after this, his mother wrote out a power of attorney for both him and his wife to use the car, “since there might be a need to use this car, or the need to cross the border.” He noted that this car “was used only by the mother and wife.”
The deputy also showed “UP” an advisory opinion from a specialist in property valuation, where the minimum value of a damaged car is indicated at 58.9 thousand hryvnia, the conclusion of the Austrian insurance company USG on the “constructive destruction of the car”, which paid the so-called “total” (total – this is a term in insurance, which means the complete loss of a vehicle, when restoring the car is impractical or impossible and does not make economic sense – ed.) to the owner, and a document from the owner of the car LLC “Kyiv Real Estate Management Company”, which offered the tenant to buy the car for 65 thousand hryvnia.
Opadchiy also provided a photo of the car. But the document with photographs shows only the front part of the car. The deputy did not provide any other photos at the time of publication.

“What seems strange is that the owner was not involved in any way in the court proceedings. They were never questioned, and during the process they were not invited to a single court hearing, and evidence was not accepted, arguing that the owner was not at the hearing. Therefore, we are preparing a complaint to the ECHR, because we have only now received the court’s decision and seen what is in it. We will file a complaint with the ECHR in the near future,” concluded Opadchiy.
